Terms and Conditions

1. Parties

These terms and conditions govern the hire of the photography studio located at 401 Saltcircle Building, 19 Kent Street, Woodstock, Cape Town (the "Studio") by Jürgen's Photography CC, Registration No: 2007/001109/23 ("the Studio Owner") to the person or entity booking the Studio ("the Renter").

By completing a booking, the Renter confirms that they have read, understood, and agreed to these terms in full.

2. Definitions

Booking

A confirmed reservation of the Studio for a specified date and Session.

Session

The agreed period of Studio use: a Half Day (any 4-hour block within 9am to 5pm) or a Full Day (8 hours, 9am to 5pm). Setup and pack-down are included within the Session.

Booking Fee

The amount payable by the Renter for the Session, as set out in Clause 4.

Damage Deposit

A refundable deposit payable in addition to the Booking Fee, as set out in Clause 5.

Equipment

Lighting equipment, cameras, computers, tether cables, and any other gear belonging to the Renter.

3. Booking Process

1. 3.1   A Booking is confirmed upon receipt of a booking confirmation email from the Studio Owner.
2. 3.2   The Studio Owner reserves the right to decline any Booking at its sole discretion.
3. 3.3   Availability is subject to the Studio Owner's own shoot schedule. The Studio Owner will make reasonable efforts to keep the booking calendar current and accurate.
4. 3.4   The Renter must provide their full name, contact number, company name (if applicable), and the intended use of the Studio at the time of booking.

4. Rental Rates

4.1   All rates are not VAT applicable. Jürgen's Photography CC is not registered for VAT.

4.2   Rates are subject to change. The rate applicable at the time of Booking confirmation will apply.

4.3   After-hours and weekend Sessions are available by arrangement. Rates for these are quoted on enquiry.

5. Payment Terms and Damage Deposit

1. 5.1   The Booking Fee is payable in full prior to or on the day of the Session, as agreed between the parties.
2. 5.2   A refundable Damage Deposit of R1,000 is payable in addition to the Booking Fee, prior to or on the day of the Session.
3. 5.3   The Damage Deposit is refunded within 7 working days after the Session, provided no damage has been caused to the Studio, its furniture, props, or fixtures, and the Studio has not required cleaning beyond normal use.
4. 5.4   If the cost of damage or excessive cleaning exceeds the Damage Deposit, the difference will be invoiced to the Renter.
5. 5.5   Payment may be made by electronic funds transfer (EFT). Banking details are sent with the booking confirmation.
6. 5.6   The Studio Owner reserves the right to withhold access to the Studio until the Booking Fee and Damage Deposit have been received and confirmed.

6. What Is Included

The Booking Fee includes the following for the duration of the Session:

• Studio access for the full duration of the booked Session, including setup and pack-down within the booked window.
• Natural daylight from large north-facing windows.
• Wall-mounted white PVC backdrop and a 2m by approximately 6m black fabric backdrop, hangable with clamps. Poly board for fill and bounce.
• Curated furniture: clothing rail with hangers, high makeup chair, bed, red leather chaise lounge, grey Chesterfield 3-seater leather couch, cream 1-seater couch, 1.8m ornate gold mirror.
• Wooden stools (tall natural, short natural, black, white) and 3 sets of apple boxes (small, medium, large) in natural, black, and white.
• 4-step functional ladder.
• Air conditioning and multiple power circuits suitable for typical strobe and continuous lighting setups.
• Refreshment facilities: kettle, microwave, fridge, and sink.
• Lift access to the 4th floor.

7. What Is Not Included

1. 7.1   Lighting equipment is not included. The Renter is welcome to bring their own lighting and other photographic equipment.
2. 7.2   Tether stations, capture computers, and tether cables are not included.
3. 7.3   Wi-Fi is not currently provided. The Renter should bring a mobile hotspot or tether off cellular if internet is required during the Session.
4. 7.4   On-site or building parking is not provided. Street parking on Kent Street is available subject to availability.
5. 7.5   The Studio Owner accepts no responsibility for the Renter's Equipment. The Renter brings all personal equipment at their own risk.

8. House Rules

1. 8.1   The Studio may be used for professional photography, video, podcasting, creative shoots, and related commercial purposes only. No events, parties, or gatherings unrelated to a shoot are permitted.
2. 8.2   The Studio must be returned to its original condition at the end of the Session. All furniture, backdrops, and props must be restored to the positions in which they were found.
3. 8.3   Setup and pack-down time must be factored into the Renter's booked Session. The Session begins and ends at the agreed times regardless of setup or pack-down requirements.
4. 8.4   A 6' wooden ladder is present in the Studio as a prop only. It must not be used as a functional ladder. The Renter must not stand on this ladder under any circumstances. A separate 4-step functional ladder is provided for legitimate ladder use.
5. 8.5   Noise must be kept at a reasonable level in consideration of other occupants of the building.
6. 8.6   Smoking is not permitted anywhere in the building.
7. 8.7   The Renter is responsible for the conduct of all persons accompanying them during the Session.

9. Cancellation and Rescheduling

1. 9.1   Cancellations made with 48 hours or more notice prior to the Session start time will receive a full refund of any amount paid.
2. 9.2   Cancellations made with less than 48 hours notice may be subject to a cancellation fee of up to 50% of the Booking Fee, at the Studio Owner's discretion.
3. 9.3   The Renter may request to reschedule a Booking, subject to availability. Rescheduling requests must be made at least 24 hours before the Session start time.
4. 9.4   The Studio Owner reserves the right to cancel or reschedule a Booking in the event of unforeseen circumstances. In such cases, the Renter will receive a full refund or an alternative date at their election.

10. Damage and Liability

1. 10.1   The Renter is responsible for any damage caused to the Studio, its fixtures, fittings, furniture, props, equipment, or any other property belonging to the Studio Owner during the Session.
2. 10.2   Any damage must be reported to the Studio Owner immediately. The cost of repair or replacement will be deducted from the Damage Deposit. If the cost exceeds the Damage Deposit, the difference will be invoiced to the Renter.
3. 10.3   The Studio Owner shall not be liable for any loss, injury, or damage suffered by the Renter or any third party during the Session, except where such loss, injury, or damage results directly from the gross negligence or wilful misconduct of the Studio Owner.
4. 10.4   The Renter indemnifies the Studio Owner against any claim arising from the Renter's use of the Studio during the Session.

11. Governing Law

These terms and conditions are governed by the laws of the Republic of South Africa. Any dispute arising from or in connection with these terms shall be subject to the jurisdiction of the South African courts.

12. Entire Agreement

These terms and conditions constitute the entire agreement between the Studio Owner and the Renter in respect of the Studio hire and supersede any prior discussions, representations, or arrangements.
